(1) These general terms and conditions apply to all contracts for the use of the Stream Plane service between Elena Maltseva (Stream Plane) (the "provider") and consumers (the "user").
(2) Deviating terms of the user do not apply. Individual agreements take precedence over these terms.
(1) The presentation of the service on the website is not a binding offer.
(2) The user creates an account. In doing so, the user accepts these terms and confirms having taken note of the privacy policy and the withdrawal notice. Upon registration, the contract for the use of the trial (§ 4) is concluded. After confirming their e-mail address, the user receives these terms, the privacy policy and the withdrawal notice in the accepted version by e-mail.
(3) A paid subscription is concluded when the user selects a plan in the dashboard, clicks the "Subscribe with obligation to pay" button and then confirms the subscription with PayPal. If fewer than 14 days have passed since the user accepted these terms, the subscription requires the user to expressly request that the provider begins performance before the withdrawal period expires, and to confirm being aware that, in the event of withdrawal, they owe compensation for the service provided up to that point (§ 11). The user then receives a confirmation of the subscription by e-mail.
(4) The language of the contract is German. The provider stores the contract text; the accepted version of these terms is sent to the user by e-mail under (2) and is available on the website.
(1) Stream Plane is a service for restreaming and multistreaming (forwarding a live stream to several platforms at the same time) and for stream protection (automatic switching to backup content when the connection drops). The scope depends on the plan booked.
(2) The provider strives for the most uninterrupted availability possible. A specific availability is not guaranteed. Maintenance, disruptions at third parties (e.g. streaming platforms, internet connections) and force majeure may limit availability.
(3) The provider may further develop and change the service as long as the contractually agreed scope of services is preserved and the change is reasonable for the user.
(1) New users can test the service free of charge with full functionality for 14 days. The trial starts upon registration.
(2) During the trial, a streaming session lasts at most 30 minutes. A new session can be started at the earliest 1 hour after the previous session has ended.
(3) After the trial ends, streaming is blocked without a subscription. The trial ends automatically and does not convert into a paid subscription.
(1) The plans shown in the dashboard are available: "Multistream" (EUR 10 per month), "Stream Protection" (EUR 15 per month) and "Bundle" (EUR 20 per month). [Pursuant to § 19 UStG, no VAT is charged.]
(2) Subscriptions are billed monthly and renew for a further month unless cancelled. Payment is made in advance via PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg) by recurring debit.
(3) The user can cancel the subscription at any time in the dashboard. The cancellation takes effect at the end of the current billing period; the service can be used until then. Amounts already paid for the current period are not refunded pro rata unless a statutory right of withdrawal applies. The right to terminate for good cause remains unaffected.
(1) The user may only use the service within the limits of applicable law. The user must not transmit unlawful content or infringe the rights of third parties.
(2) The user is responsible for complying with the terms and policies of the platforms to which they stream (e.g. Twitch, Kick, YouTube, Trovo). The user keeps their access data and stream keys confidential and protects their account against unauthorised access.
(3) The provider is entitled to temporarily block access if the user materially breaches these rules or endangers the security of the service. The user will be informed beforehand where possible.
(1) The provider may change these terms with effect for the future if there is an objective reason (e.g. a change in the law, further development of the service).
(2) Changes are notified to the user by e-mail at least 30 days before they take effect. The notice points out the change, the date it takes effect and the consequences of remaining silent.
(3) If the user continues to use the service after the period has expired, the amended terms are deemed agreed. The provider expressly points out this consequence in the notice.
(4) A user who does not agree with the changes can deactivate their account before the change takes effect (§ 8). A running subscription then ends under § 5 (3).
(1) The user can deactivate their account at any time in the dashboard. Their personal data is anonymised in the process. Payment records are retained for the statutory retention period (see privacy policy).
(2) An existing subscription must be cancelled before deactivation; it ends under § 5 (3).
(1) The provider is liable without limitation for intent and gross negligence and for injury to life, body or health.
(2) For slight negligence, the provider is only liable for breach of an essential contractual obligation (an obligation whose fulfilment makes performance of the contract possible in the first place and on whose observance the user may regularly rely), limited to the foreseeable damage typical for the contract.
(3) Liability under the Product Liability Act (Produkthaftungsgesetz) remains unaffected.
Information on the processing of personal data is given in the privacy policy.
Consumers have a statutory right of withdrawal. Details are set out in the withdrawal notice. For the early start of performance when concluding a subscription, see § 2 (3).
(1) The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the country in which the user has their habitual residence remain unaffected.
(2) If a provision of these terms is invalid, the rest of the contract remains valid; the statutory provisions take the place of the invalid provision.
