The controller responsible for the processing of personal data on this website and in this service is:
Elena Maltseva (Stream Plane), c/o IP-Management #12030, Ludwig-Erhard-Straße 18, 20459 Hamburg, Germany
E-mail: business [at] streamplane [dot] com
Stream Plane does not use cookies, analytics or tracking services. After login, only data that is technically necessary to keep you logged in is stored on your device (§ 25 (2) TDDDG). We process personal data only as far as necessary to operate the service, perform the contract and comply with legal obligations.
We operate the service and the associated database with a hosting provider on servers in the European Union.
When you visit the website and use the service, technically necessary data is processed, in particular your IP address, date and time of the request, the page requested and information about your browser and operating system (server log files). This serves the secure and stable operation of the service (Art. 6 (1) (f) GDPR). Log files are deleted after a short time.
A data processing agreement (Art. 28 GDPR) exists with the hosting provider. For transfers to third countries see section 11.
When you register, we process your name, e-mail address and password (stored only as a hash) as well as the status of your account (e.g. e-mail confirmed, end of trial). The legal basis is Art. 6 (1) (b) GDPR (performance of a contract).
To provide the service, we store your stream configuration (e.g. your stream key and the target platforms you chose). We also process technical data about your streams (e.g. the connection status) and the start and end of your streaming sessions, which we also use to enforce the limits of the trial. The legal basis is Art. 6 (1) (b) GDPR. We forward the content of your stream (video and audio) only to the targets you configured and do not store it.
If you voluntarily link your account with Telegram, we store your Telegram user ID and your Telegram username in order to send you notifications via Telegram. The legal basis is your consent (Art. 6 (1) (a) GDPR), which you can withdraw at any time with effect for the future by removing the link. Telegram is independently responsible for message transmission; Telegram's privacy policy applies.
When you write to us by e-mail or we send you e-mails (e.g. e-mail address confirmation, sending the accepted legal documents, contract confirmation, change notices), we process your details to handle your request or to perform the contract (Art. 6 (1) (b) or (f) GDPR). For sending and receiving we use an e-mail service provider acting on our behalf (Art. 28 GDPR).
Payments for subscriptions are processed via PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg). We receive from PayPal details about your subscription and payments (e.g. plan, amount and payment status) as well as your name and e-mail address. The legal basis is Art. 6 (1) (b) GDPR; statutory tax and commercial retention obligations: Art. 6 (1) (c) GDPR. PayPal is independently responsible for the payment; PayPal's privacy policy applies.
You can withdraw from a contract using the "Vertrag widerrufen" button in the dashboard. In doing so we process your name, the details identifying the contract and your e-mail address in order to confirm receipt (Art. 6 (1) (c) GDPR in conjunction with § 356a BGB). The data is stored and deleted together with the contract data.
At registration we store the time of your consent and the version of the terms and conditions, the privacy policy and the withdrawal notice that you accepted. We also store details on the early start of performance and on withdrawal, and when we sent you change notices regarding the terms and conditions, the privacy policy and the withdrawal notice. The legal basis is Art. 6 (1) (c) GDPR (proof of statutory information duties) and (f) (defence of legal claims). We store this data until the end of the third calendar year after the year of consent (regular limitation period, §§ 195, 199 BGB).
If you deactivate your account, your personal data is anonymised. We retain payment records in accordance with tax and commercial law (currently 8 years, § 147 AO; Art. 6 (1) (c) GDPR).
We pass on personal data only as far as necessary for the purposes stated in this policy. Recipients are in particular:
hosting provider (see section 3),
e-mail service provider (see section 7),
payment service provider PayPal (see section 8),
Telegram, if you use the linking (see section 6),
authorities and advisers (e.g. tax advisers), where we are legally obliged to do so.
Service providers processing data on our behalf are bound by data processing agreements (Art. 28 GDPR). On request we will name the specific recipients.
We store your data in the European Union. Where a service provider processes data outside the EU in individual cases, this takes place only on the basis of an adequacy decision of the EU Commission (Art. 45 GDPR, e.g. the EU-US Data Privacy Framework) or EU standard contractual clauses (Art. 46 (2) (c) GDPR).
We protect your data by appropriate technical and organisational measures, including encrypted transmission, access restrictions and storing passwords only as a hash. Please note that data transmission on the internet (e.g. by e-mail) can generally have security gaps; complete protection against access by third parties is not possible.
Account data, configuration and streaming sessions: until the account is deactivated, then deletion or anonymisation
Technical stream data: only while streaming, not stored
Proof of consent and change notices: until the end of the 3rd calendar year after consent
Payment records: under tax law (currently 8 years)
Telegram link: until the link is removed
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to withdraw consent given with effect for the future (Art. 7 (3)). Please contact business [at] streamplane [dot] com.
Right to object: where we process data on the basis of legitimate interests (Art. 6 (1) (f) GDPR), you may object at any time on grounds relating to your particular situation (Art. 21 GDPR).
You also have the right to lodge a complaint with a data protection supervisory authority, e.g. the Berlin Commissioner for Data Protection and Freedom of Information (Berliner Beauftragte für Datenschutz und Informationsfreiheit), Alt-Moabit 59–61, 10555 Berlin.
Providing your name and e-mail address is necessary for registration and use of the service; without them we cannot conclude a contract. The Telegram linking is voluntary.
