Terms of Service

1. Agreement to Terms

By accessing or using Stream Plane, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the service. These terms are governed by applicable European Union legislation, including the EU Consumer Rights Directive (Directive 2011/83/EU) and the Digital Services Act (Regulation (EU) 2022/2065).

2. Description of Service

Stream Plane is a live streaming management platform that enables users to broadcast their live streams across multiple platforms simultaneously, with features including multi-platform restreaming, broadcast protection with automatic failover, custom backup content, and real-time stream monitoring.

3. Beta / Testing Disclaimer

Stream Plane is currently in a beta / testing phase. As such, the service may contain bugs, errors, or other technical issues that could affect your experience, including but not limited to stream interruptions, data inconsistencies, or temporary feature unavailability. We are actively working to improve the service and appreciate your patience and feedback during this period.

During the beta phase, we do not guarantee any specific level of uptime, availability, or performance. The service is provided on an "as is" and "as available" basis.

4. Account Registration

To use Stream Plane, you must create an account by providing a valid email address and password. You must be at least 18 years of age to register. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

5. Subscription and Payment

Stream Plane offers subscription-based plans. All payment processing is handled by PayPal. By subscribing, you agree to PayPal's terms and conditions for payment processing. We store transaction records (including transaction identifiers, amounts, currency, and payment status) in our systems for billing, compliance, and customer support purposes.

Subscriptions are billed on a monthly recurring basis. You may cancel your subscription at any time through the dashboard. Upon cancellation, your subscription remains active until the end of the current billing period.

We reserve the right to change our pricing at any time. Any price changes will be communicated to you in advance and will take effect at the start of your next billing cycle. Your continued use of the service after a price change constitutes your acceptance of the new pricing.

New features or capabilities may be offered as separate add-on packages and may not be included in your current subscription plan. Access to such features may require an additional purchase or an upgrade to a higher-tier plan.

Right of Withdrawal (EU Consumers)

In accordance with the EU Consumer Rights Directive (Directive 2011/83/EU), you have the right to withdraw from your subscription within 14 days of purchase without giving any reason. However, by starting to use Stream Plane's digital services immediately upon subscription, you expressly consent to the performance of the service beginning before the withdrawal period has ended and acknowledge that you will lose your right of withdrawal once the service has been fully performed.

6. Acceptable Use

You agree not to use Stream Plane to:

  • Stream, distribute, or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Infringe upon the intellectual property rights of any third party
  • Distribute malware or engage in any activity that disrupts the service
  • Attempt to gain unauthorized access to Stream Plane's systems or other users' accounts
  • Use the service for any purpose that violates applicable local, national, or international law

We reserve the right to suspend or terminate your account if you violate these terms.

User Responsibility for Content

You are solely responsible for all content you upload, transmit, or stream throughStream Plane, including its legality, reliability, and appropriateness. This includes ensuring you have all necessary rights, licenses, and permissions for any content you broadcast. Stream Plane does not monitor, pre-screen, or endorse user content and accepts no liability for content streamed by users.

7. Intellectual Property

The Stream Plane platform, including its software, design, logos, and documentation, is the intellectual property of Stream Plane and is protected by applicable intellectual property laws. You retain all rights to the content you stream through our service. We do not claim ownership of your content.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Stream Plane and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, including but not limited to:

  • Lost or interrupted streams
  • Loss of viewers or audience engagement
  • Technical failures or service downtime
  • Data loss or corruption
  • Any issues arising from the beta / testing nature of the service

This limitation applies regardless of the legal theory under which liability is asserted. Nothing in these terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable EU law.

9. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account if you breach these Terms of Service or if we discontinue the service. Upon termination:

  • Your right to use the service ceases immediately
  • Your streaming configurations will be deactivated
  • We may retain certain data as required by law or for legitimate business purposes, in accordance with our Privacy Policy

10. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the European Union and the applicable national law of the Member State in which the service operator is established. Any disputes arising from or relating to these terms shall be subject to the jurisdiction of the competent courts of that Member State.

In accordance with Regulation (EU) No 524/2013, consumers residing in the EU may submit complaints through the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

11. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. We will notify registered users of material changes via email or through a notice on the service. Your continued use of Stream Plane after such changes constitutes your acceptance of the revised terms.
